The Tilbury Auto Mall Mobile Festival Event Stage Booking Request

Basic Conditions of Use

1. Borrower must obtain liability event insurance with The Tilbury Auto Mall named as additional insured and provide a copy of the certificate of insurance no later than 45 days prior to the stage arrival date.
2. The borrower is responsible for any and all damages and agrees to fully reimburse The Tilbury Auto Mall for 100% of the cost of any and all repairs required to the stage unit, its accessories, including graphics and signage, due to damage while in your care and possession, however caused, including but not limited to gouges in the stage surface caused by dragging heavy items across it or any similar mishap.
3. The borrower is responsible for ensuring clear and expedient ingress and egress at the event site and agrees to pay any and all costs associated with any services which might be required to remove either the tractor or trailer unit due to unfit ground conditions.
4. The borrower is responsible for ensuring all electrical hookups are carried out according to local codes by a certified professional.
5. The borrower agrees to ensure the trailer stage is secured from any and all unauthorized use while in your care and possession.
6. The borrower agrees to ensure the stage unit is returned in a clean state with any garbage or other materials removed and understands that any cleaning fees incurred may be deducted from your security deposit.
7. The borrower agrees to provide, no later than 45 days prior to delivery, a security deposit in the amount of $500, by cheque, which will be returned on pickup if all care and maintenance conditions have been met.
8. The borrower agrees to pay all associated transportation costs with the delivery and return of the stage unit at a rate of $XXX. Delivery driver’s hourly rate of $100 per hour will be deducted from security deposit if the driver is made to wait more than 15 minutes from your designated drop off or pickup times as outlined in the above booking request.
9. By submission of this application form - the “applicant” outlined above represents that he/she is empowered to execute this agreement to borrow the Tilbury Auto Mall Festival Event Stage on behalf of the event/organization outlined above. Furthermore, the applicant represents that he/she has read the accompanying detailed Terms of Use Agreement, understands it, and agrees to all conditions therein.

The applicant, event organizers, and organization officers and members agree to indemnify, defend and hold harmless The Tilbury Auto Mall and it’s officers and members against all loss or expense by reason of liability imposed by law upon The Tilbury Auto Mall for damages because of loss of revenue or bodily injury, including death, at any time resulting therefrom, sustained by any person or persons, or on account of damage to property, including loss of use thereof, arising out of or in consequence of the performance of this contract, whether such loss of revenue, injuries to persons or damage to property is due or claimed to be due to the negligence of the contractor, The The Tilbury Auto Mall, it’s officers or representatives.

The applicant, event organizers, and organization officers and members hereby voluntarily releases and forever discharges The Tilbury Auto Mall, its agents, officials, employees and volunteers from any and all liability, claims, demands, losses and expenses, actions or rights of action which arise out of, or are in any way related to, or connected with, their participation the use of The Tilbury Auto Mall’s equipment and/or facilities described herein including specifically, but not limited to, any and all injury, death, illness or disease, and damage to myself or to my property, or to property under their.

The applicant, event organizers, and organization officers and members further agree, promise and covenant to hold harmless, defend and indemnify The Tilbury Auto Mall, its agents, officials, employees and volunteers from all defense costs, including attorney’s fees, or from any other costs incurred in connection with claims for bodily injury or property damage caused in whole or in part by any negligent act or omission of the applicant/borrower, anyone directly or indirectly representing and/or employed by any of them or anyone for whose acts any of them may be liable, except where caused by the active negligence, sole negligence, or willful misconduct of The Tilbury Auto Mall.

The applicant, event organizers, and organization officers and members agree that The Tilbury Auto Mall Festival Event Stage coordinator may add conditions to a reservation and agree to the rules outlined in this document, as well as all rules and regiulations posted in or on the trailer stage itself and in the approcal email.

The applicant, event organizers, and organization officers and members further agree, covenant and promise not to sue, assert or otherwise maintain or assert any claim against The Tilbury Auto Mall, its agents, officials, employees and volunteers for any injury, death, illness or disease or damage to them or to their property, or to property, including municipal property where the event is being held, arising from or connected with their use of The Tilbury Auto Mall’s equipment facilities or from any claim asserted against them by any other person.

I have read, I understand, and I will comply with all the information on this application, information posted in or on the trailer stage itself in the supplemental rules and regulations handout.

The Tilbury Auto Mall Festival Event Stage Application shall be be completed only by responsible adults, 21 years and older, who shall be in attendance at the function for which The Tilbury Auto Mall Festival Event Stage Application is made.

The Tilbury Auto Mall stage coordintor and/or delivery driver has discretion in deciding the appropriate location at the event site to park the mobile stagein order to prevent accidents and damage to existing facilities.

Refundable the Security Deposit: If approved after the event, the refundable deposit will be mailed to the applicant listed on The Tilbury Auto Mall Festival Event Stage Application. Checks are issued within three (3) weeks of the stage’s return. The refundable deposit may be withheld for reasons outlined here: Damage or vandalism to The Tilbury Auto Mall stage facilities or equipment; stage returned in need of cleaning; missing or stolen equipment.
